Liability Waiver & Release of Claims

“In devotion to the Sacred Waters, may this agreement honor safety, respect, and flow.”

Acknowledgment of Risk

I understand the risks involved in retreat activities including hiking, waterfalls, swimming, and exploring natural sites.
These risks may include but are not limited to:

Slippery, uneven, or unstable terrain
Falling rocks, branches, or debris
Risk of slips, trips, and falls
Exposure to natural elements (sun, rain, insects, wildlife)
Physical exertion in hot and humid conditions
Accidents or injuries during transportation to and from activities

Health & Fitness Declaration

I confirm that I am physically and mentally capable of participating and have disclosed any relevant medical conditions to the organisers.

Release of Liability

I release and discharge the retreat organisers, facilitators, employees, contractors, and partners from liability for injuries, loss, or damages that may occur during my participation, whether caused by negligence or otherwise.

Assumption of Personal Responsibility

I accept responsibility for my own safety and well-being during the retreat.
I will follow instructions given by retreat facilitators.
I am responsible for obtaining travel insurance, motorbike insurance, medical coverage and personal transportation.

Third-Party Providers

I understand that Temple of the Living Waters is not liable for the actions, negligence, or services of third-party providers, including airlines, hotels, transport companies, or activity operators.

Drugs & Alcohol

I agree not to consume alcohol or drugs in a way that impairs my judgment, safety, or ability to participate in activities. I understand the organisers are not responsible for accidents or injuries resulting from such use.

Personal Property

I accept full responsibility for my personal belongings and understand the organisers are not liable for loss, theft, or damage to my property.

Medical Authorisation

I authorise retreat organisers to obtain medical treatment for me in the event of an emergency and accept financial responsibility for any related costs.

Governing Law

I understand that this waiver is governed by the laws of New South Wales, Australia for all booking, payment, and contractual matters, and by the laws of Indonesia for all activities taking place during the retreat.

Binding Effect

This release is binding upon me, my heirs, executors, administrators, and assigns.

Acknowledgment of Understanding

I acknowledge that I have carefully read and understood this waiver and voluntarily agree to its terms.
I understand that I am giving up substantial legal rights, including the right to sue.
